Tennessee DePuy Hip Implant Lawsuits & Settlements

Local Nashville, Knoxville & Memphis product liability attorneys stand up to defective hip replacement manufacturers on behalf of victims and their families

If you've experienced physical and financial suffering from a DePuy metal-on-metal hip replacement, first you should know that you aren't alone. Far from it. Over 19,000 people have filed personal injury lawsuits against DePuy for their defective Articular Surface Replacement (ASR) and Pinnacle hip implants. Verdicts and settlements from these cases have already added up to more than $6 billion. Thousands of lawsuits are currently pending, even while more still are being filed.

DePuy Orthopedics is one of the largest hip replacement manufacturers in the world, matched only by companies like Stryker, Smith & Nephew, Zimmer Biomet, and Wright. The orthopedic company, owned by Johnson & Johnson, sells individual hip implant components such as femur stems, femoral heads, and acetabular cups, as well as complete hip replacement systems.

In August 2010, DePuy issued its first hip system recall after it was revealed that their ASR devices were failing at an unusually high rate. While the company has yet to issue a recall on their Pinnacle implant, many patients have reported similar health problems associated with the ASR metal-on-metal replacement.

Surgeons warned DePuy to stop selling their ASR hip implants, and internal documents have since proven that J&J executives knew about the faulty design but kept the product on the market anyway. This blatant negligence of putting profits over people won't be tolerated. I believe greedy medical device manufacturers must be made to pay for endangering human lives.

DePuy Hip Implant Lawsuit FAQs

DePuy recalled its ASR XL Acetabular metal-on-metal hip replacement system on August 24, 2010. The ASR Hip Resurfacing System was also recalled from the global market, but this device wasn't commercially available in the U.S.

The DePuy Pinnacle implant, though never recalled, appears to have the same higher risk of failure as the ASR system.

According to lawsuits filed against DePuy and other hip manufacturers, defective metal-on-metal implants have led to serious injuries and complications that require revision surgery. Damages have included:

Back in August 2012, Bloomberg reported that three ASR hip implant lawsuits settled for roughly $200,000. Other notable DePuy cases have resulted in settlement awards ranging from $300,00 to $8.3 million.

One of the largest DePuy settlements to date was granted in March 2016 by a Texas court. The award initially totaled $502 million ($142 million in actual damages and $360 million in punitive damages), but was later reduced to $151 million under Texas law.

The reality is that nobody can tell you the exact value of your individual case. We can only estimate based on our experience and the details of your unique situation. Beware any attorney who says that they “know” how much your DePuy hip lawsuit will settle for and that they can settle your case for a large amount of money without knowing all the details.

Currently, there are no class action lawsuits over the defective DePuy hip implants. In 2010, a federal panel combined individual ASR lawsuits into multidistrict litigations (MDLs), but in a majority of DePuy hip cases people must file complaints on an individual basis.

DePuy hip replacements lawsuits must be filed individually by the person who was injured physically and/or financially by the faulty implant. Pinnacle and ASR lawsuits require a deep understanding of medicine and medical devices, which is why it's important that you consult a product liability attorney who specializes in defective medical devices and can skillfully navigate this complex process.
