DePuy Hip Implant Lawsuit FAQs
DePuy recalled its ASR XL Acetabular metal-on-metal hip replacement system on August 24, 2010. The ASR Hip Resurfacing System was also recalled from the global market, but this device wasn't commercially available in the U.S.
The DePuy Pinnacle implant, though never recalled, appears to have the same higher risk of failure as the ASR system.
According to lawsuits filed against DePuy and other hip manufacturers, defective metal-on-metal implants have led to serious injuries and complications that require revision surgery. Damages have included:
- Dislocation
- Loosening
- Metallosis (metal poisoning)
- Swelling
- Hip pain
- Infection
- Bone fracture
- Tissue damage
- Difficulty walking
Back in August 2012, Bloomberg reported that three ASR hip implant lawsuits settled for roughly $200,000. Other notable DePuy cases have resulted in settlement awards ranging from $300,00 to $8.3 million.
One of the largest DePuy settlements to date was granted in March 2016 by a Texas court. The award initially totaled $502 million ($142 million in actual damages and $360 million in punitive damages), but was later reduced to $151 million under Texas law.
