Occupational Disability

A disability due to a work-related accident is devastating to the employee and to family members and friends. Under the Tennessee Workers' Compensation Law, the state requires that all workers who have suffered occupational disabilities receive two-thirds of their wages. This applies to all disabilities, whether permanent or temporary, partial or full, for a period of up to 400 weeks.

The law is designed to alleviate the panic and grief usually associated with becoming disabled on the job. Bill payments and daily necessities do not go away when one is taken out of employment because of a disability. Compensation laws cover a disabled worker's medical bills, medication, and day-to-day needs while out of work. If a debilitating injury is found to be eligible for worker's compensation by the state of Tennessee, health care providers cannot bill the employee for services rendered. Employees may also be entitled to further benefits paying for any debilitations, limitations and inconveniences after medical treatment has concluded.

Insurance carriers pay compensation. Wage statements must be submitted to the carrier in order to determine the full amount paid to the employee while on disability. An attorney's role in disability compensation cases should be to determine if an employee has a disability that will be recognized in a court of law. The attorney should then help the employee negotiate between the employer and insurance carrier and to assist in related paperwork. However, there are also attorneys specially hired by the insurance company who work against the employee to lower the cost to the carrier. Every day, insurance companies take advantage of employees who are desperate to reach a settlement and get even a small portion of compensation to help pay off bills and expenses.
